Youtube Copyright Claim Help?

    So the other day I made a Naruto Shippuden AMV to Back Against the Wall by Cage the Elephant
    I researched Fair Use for 2 hours and realized my video had to 1. Transformative 2. Non-commercial 3. Use no more work than the intended purpose requires, and 4. Doesn't harm the original contents market

    My video had all 4 of these things yet when I disputed the claim under Fair Use I came back this morning to find my video has been deleted, and another strike added to my account.
    I'm only 14 so I'm not willing to go to court over this, but can I send an e-mail or anything like that?

  • Youtube is becoming a fan for a Copyright infringement....2 years ago, such policy haven't existed..but now, it is getting less viewable and more people just tends to beg for youtube to give them their claim of ownership, so that they could edit their channels, playlists, features, custom thumbnails and much more....not many Youtube partners claims to have such options, except for the super popular ones (e.g. Pewdiepie)
    Be or not be....what matters is being yourself....don't panic under any circumstances....try to be normal...and imagine yourself lying on an open plain grassfield filled with strong wind blowing around you, the sun shines, and the sky is clear as blue....and relax..... :thumbsup:

  • Naruto Shippuden is an ongoing anime. Thus it takes a lot of risk to upload it online. Been a mixer before and it didn't go so well. Trust me. Naruto Shippuden is COMMERCIAL, you do not own it. It's copyright. Just in case you don't know, you can either mirrored your footage so it takes a lot more harder to take it down.(in my opinion) or just don't upload anime music video anymore.

    You see,YouTube gives copyright claims like a cheap prostitute gives STDs [I got 3 copyright claims on original songs I made and to this day I have no idea why].
    Your video is different tho,since everything you used actually is copyrighted,so I guess there's pretty much nothing you can do.

    Yeah I understand that since Pewdiepie is popular he gets permission to use that content. But after what I've seen it seems like Youtube doesn't follow Fair Use very well
    Well the thing about this guys is I did mirror the video and this I'm extremely sure follows under the Fair Use part of the copyright law.
    If it falls under Fair Use it means the companies can't claim copyright on it since it doesn't break the rules of the 4 things I put in the original question

    Yeah, it doesn't. And that not only concerns me, but people who are trying so hard to get to the top as well...Youtube should have left the policy away, rather than adopting that type of a policy...

  • According to a video LittleKuriboh did, he said he made counter claims on all of his abridged work to ensure it got uploaded on Youtube. That might help.

    The biggest problem I have been told by my friend on FB is that Youtube now has bots that will automatically take down or mute videos without someone actually filtering them, which to me seems pretty silly. In a way you are promoting the anime, but Youtube's fixation on copyright infringement has made it difficult for lots of people, so don't feel you are alone okay? :)

Or was it just a claim saying some works involved are owned by this company, thus ads will be displayed. If it was the latter, you should not have disputed it. It was just stating "Hey, these people own this. You can still use it, but they will get money from the ads, not you."

    Fair use is a tricky thing to deal with. I believe the main reason why it was taken down was because of the song, not the anime. Unless the song was transformed too, as in sped up, slowed down, etc. Then it wasn't transformed, thus resulting in the strike and deletion. You have to understand that fair use isn't giving you the rights of ownership, it's giving you the rights to use the content. I have a lot of videos on my channel that have been labeled with copyright claims, but allow the video to still be available, in full, just with ads. Which I don't mind at all, as it is not a strike against my account.

    Simply, unless they told you to remove the video, don't try disputing any claims, as it will just come back to bite you in the butt.

  • YouTube is very iffy about copyrights, and their automated system is complete crap. I've had them remove videos that had nothing but me talking on webcam or things like that, and then ask me for proof I owned it (because my face totally isn't on my damn profile.) They never did apologize for that, and I don't expect that it'll ever happen.

    Well the thing about it is it was blocked worldwide even though I mirror the video. Also When I received the strike it was about the anime from TV Tokyo. I did dispute the claim because looking into it it IS fair use. Sadly my video wouldn't even let ads and to the others I'm 14 and a counter-notice could get me sued...I'd rather stay away from that with a middle class family lol, and abdull yeah because my video (talked to law school teacher at high school) said it WAS fair use

  • I'm not 100% sure about this since my experience comes from my Let's Plays. For me the infringements were false positives by Youtube's bot and I would file a dispute and after about 2 weeks the dispute would run out of time and the claim would be dropped. But since it did this even for games that I disabled music for and not actual copyrighted songs. It's a huge pain since Fair Use is truthfully pretty vague at best.

  • Well Bing is trying to fight Google as a search engine. Maybe Microsoft will also create a new video uploading site with PROPER service, standards and assistance.

    Half the time even if you get copyright claims and stuff and you try to appeal, you'll never hear back. They're like slackers on slacker acid. It's freaking Google! If you don't have enough people hired to go through the amount of videos you get sent, hire more people. They would could create a job market and solve world hunger with the amount of jobs they could open up XD.
