    So, I'm quite upset at the moment.
    I've started doing an LP of Silent Hill: Homecoming recently and I have/had 3 videos up on my YouTube channel.
    Well, each video is getting a "third party content" placed on it because of the in-game music being owned by Konami.
    I wanna get partnered in the future and I know that you cannot have any copyright issues on your channel so I deleted the videos.
    This leads me to believe I won't be able to play any other Silent Hill game due to the fact that they're full of Konami owned music and I don't wanna get more issues.
    Is there any way around this or removing the game music? I'd hate to have to go around certain games just because of that.


  • I feel for you, I got my whole channel taken off for posting a LP of Metro 2033 because some of the audio was used in a review of the game somewhere 0-0 It really got me down, especially as I can't even search up the old channel - Only a 404 error :0

    One thing you could do is not record game audio, and find some non copyrighted music to play in the background. This won't be as good as the actual game music, but will still make the viewer more interested in the game then just you talking. Perhaps if you were really dedicated to the videos and editing you could edit the audio to fit the current game situation. You could also poke some fun at situations (playing happy music at sad moments e.t.c). This could be a great chance to prove that you can edit audio well, and could make the LP better than it already is!

  • I have had this problem recently with my Dead Island Riptide playthrough but I always save the edit of my video before rendering incase any problems occur. I removed 2 videos due to there being too much too just edit out, and on another one, I went back to the edit, cropped out the copyright music and just did some commentary over it explaining why its silent and just talked about the game until I was out of the copyright zone so yeah, always save the edit before render, and just go back to it if needed :)

    Indeed, game publishers, especially their legal departments, are mostly about blind-fire-and-forget. Bear in mind how many fan projects have been C&D'd the last few years.

    I'm kinda bumping the tread (sorry for that), but some things are still not clear to me and I don't want to create other topics.


    What intrigues me is that so many youtubers uses copyrighted songs as background (like Remi Gaillard, Pewdie's SoD outro etc.) or in-game (all Just Dance gameplays which, contrary to singstar, have original songs). So my question is - do they really contact the companies about using every song? I can imagine Pewdie asking for permission for song he's gonna use as regular outro, but for one video only?
    And one more thing, based on Pewdie's gameplays. What's the actual difference between soundtracks from games (like HeavyRain OST which was released) and songs used by game (Just Dance) in terms of copyrights? Simple example - Pewdie plays Fahrenheit and does not cut music composed to this game, but does cut song during Tyler's 'sex' scene.

    Lot's of question from a new user, but I'd like to post some videos on yt, and with my ideas, songs are pretty important. Therefore I'd like to avoid any violation.

  • Well , the bigger YouTubers are kinda reckless regarding copyright issues due to the fact most of the time the network which they are partnered in do all the talking for the copyright and such for that specific YouTuber , that is atleast what I expect. Either way , the big YouTubers are setting a bad example by using copyrighted work in their videos which may trigger other people doing it , only for them there will be (bigger) consequences.

    Games like Just Dance use copyrighted content from Third-Parties , meaning that they didn't make it for that game specifically and that there is another party involved (The Artist/creator of the content). Games like Just Dance/Brutal Legend/Guitar Hero (any game that uses third-party copyright content) should be avoided especially on Youtube.



  • Well, thanks for the fast response. It's kinda ironic though that playing JD, which is one of the most 'violating' games, is so common among youtubers.

    What about music made specifically for the game? Even if it became released afterwards(like Heavy Rain, Hitman etc.), is it a violation not to cut it from gameplay?

    I cannot tell wether it will get you in trouble or not , but most of the time it is 'allowed' to record OST if its is made for that game specifically, BUT there have been people gaining claims/strikes due to it (For example in a part of Uncharted 3 where some action music plays). So I recommend if you would play a game 'mainstream' game that you would provide commentary about the game etc. (actually what many lets-players do) to make the whole video for 'fair-use' by doing so , which also means that you have a bigger chance at fighting claims and strikes, but if you are really unsure about stuff and/or want to play it safe , you could disable the music for most games in the settings.



  • If you're not planning on making money on a video, there's a youtube tag (thing) that links the music back to the owner. A lot of my friends use it when they put a song in the background of the video. As far as I know, it just credits the originator and links to them.

    In the comment box, it gives someone a link to buy the music.

    I wouldn't know how you would get around it if you did want to make money. I honestly confused how the entire content of the game doesn't count as 3rd party.
