  • Copyright and Partnership

    I'm confused on this part and so I figured I'd drop by and ask. I was researching partners and I notice they say you have to be 100% copyright free. Which makes sense, shouldn't make money if its copyright, just like monetization is omitted from those videos. However, we all know partners still do upload copyrighted content, how are they allowed to on their channels and still be partnered? For instance, a few of the games I've covered have had copyright claims on them, not strikes, just "blahblah music or image was found in the video". These exact same cutscenes and stuff can be found far and wide on more popular channels, but if you have to be 100% copyright free, how come they get to do it?

    That's basically my question. My channel has quite a few copyrights from games I've played with cutscenes, and some of my earlier videos contained music violations before it was an LP channel. Why would I remove them just for this? Especially when you consider the fact that I will be playing games that will inevitably copyright again just because it's SO easy. One partner FAQ said you couldn't because profiting from other people's work = bad, but said videos can't be omitted from the partnership program just as YouTube automatically omits them from monetization?

    That's the only way it makes sense that people can have stuff that I know strikes a copyright and still maintain partnership, unless bigger partnerships they're just like "You're so popular and making us so much money who gives a damn, we'll do anything for you :D!!!"

  • Let me shed some light on the subject for you :)

    Here is what you can put in your videos;

    Original content such as;
    Songs created by you whose sounds were in a creative studio made to create songs that are royalty free (ill get to royalty free things in a moment)
    Videos where it may be just vlogs (without music in the background)
    Stop motion animation where everything was created by you
    Etc.

    Things you can not use in your videos;

    Images not taken by you
    Videos not recorded by you
    Gameplay (I'll get to this in a moment)
    Music
    other content not created by you such as art etc.

    Here's where you CAN upload the above things under these conditions.
    You must recieve written consent by the author and/or creator of the media, but not only consent, the consent to MAKE MONEY off of the said media (if monetizing the video) and you must either get this in writting or a screenshot where they state something like: "I VcentG allow "BurstCraftGaming" to use this song "AwesomeSauce" in his videos under youtubes monetization law."

    Royalty free media:
    Here's where this gets tricky. People seem to think if you add royalty free music into their video, they are safe and can then monetize the video, this is uncorrect.
    Sure they allow you to download use and edit the said media for free, but they are NOT allowing you to make money off of the media unless they give their direct say so.

    Gameplay;
    can be VERY tricky because some games allow you, some do not. This is where gaming networks get involved and is why it's beneficial to be in one.
    Take World of Warcraft for example, in their clause it states that we CAN monetize videos with their game in it so long as they are partnered with any network including just being a REGULAR youtube partner.
    As of april this year anyone who creates a video and gets it monetized is automatically a youtube partner, so for that particular game, you're safe.

    On the other hand 'Halo 4' Before it was released Microsoft revoked all rights to anyone making any halo media as they wanted to hold it for themselves. I do believe this has changed and they've given it to some networks, but don't quote me on that.

    Now one note, yes from time to time you will see users posting things they do not have permission to use, yes our infamous pewdiepie has done it abit alot, flashes or music and images etc, but this is terribly risky and i don't suggest doing it because a small channel not making google any money has more of a chance being banned than a 3million sub channel that drives alot of people to their website. Now in saying that, note that in youtubes terms it states that if you have had an account terminated you are not allowed to ever posses, use, or create any other channel ever again, so be very careful. Do not risk it, especially if you are thinking about it being a career path :)

    So there you go, you're now educated on what you can and can not monetize :D
    Imm'a go and be awesome now, have fun :)

    P.S Let me know if you need anymore questions answered, cheers :)

  • Fun fact that I just asked koggeh for full permission to record Ratchet and Clank games including cut scenes xD. He said yes, if you didn't know , he works @ Insomniac games <3

    Also a bit wrong on the YouTube partner and gaming though , if you have moneytization on it will make you a youtube partner but it will not give you that much permission for big games. Its best to partner up with a gaming network to be sure and such.

    EDIT : Cutscenes should be mainly avoided since it can be copyrighted seperately by for example the company who made them (and not the actual developers) , the voice acting might be copyrighted aswell and other bullcrap.

  • Kinda answers my question but at the same time not really. The copyright isn't my thing. I don't care about what you can or can't monetize, my thing is where partnership programs say you can't have ANY copyrights to join them. Therefore are they making exceptions as long as each copyright is properly commentated over and all of that or what? Because we know partners do have videos that catch copyright claims.

    Aka I'm asking more about the partnership programs themselves, not youtube's rules.

    As far as I know TGN is the only one supporting non-commentary gaming videos and such, while the majority of the networks decline that. In fact , I got rejected by socialblade/RPM due to this (luckily... they are recruiting EVERYONE nowadays, so they are on my bad side).

  • As a SocialBlade partner myself I would say to not bother with them. Their support sucks and they seem to be only out for money and make no attempt to promote you, thus why they are taking anyone as if they are some kind of massive noah's arc that sails straight to hell. I have only been with them a short while so that may change but their founder seems to only care about making his crumby Vlogs than helping out his wide portfolio of content creators that have chosen his network to make videos for.

    Copyright wise they don't really have any exclusive rights like a Machinima. SocialBlade can only give you a selection of unlicensed music from their own archives meaning that recording certain games is still a no go unlike Machinima as I mentioned.
